1. Application of These Terms

1.1 These Terms & Conditions apply to all goods and services supplied by Sell Selling Sold Pty Ltd trading as Roofers Warehouse (“Roofers Warehouse”, “we”, “our”, “us”).

1.2 By placing an order with Roofers Warehouse, the customer agrees to be bound by these Terms.

1.3 These Terms prevail over any terms provided by the customer unless expressly agreed in writing by Roofers Warehouse.

2. Orders & Contract Formation

2.1 A binding contract is formed when Roofers Warehouse accepts an order, whether placed verbally, electronically or in writing.

2.2 Any quotation provided:

• Is valid for 30 days unless otherwise stated;
• May be withdrawn or varied prior to acceptance;
• Is provided as an estimate only.

2.3 Prices are exclusive of GST unless expressly stated otherwise.

2.4 Where measurements, quantities or material estimates are discussed or provided, they are indicative only. Customers remain responsible for confirming all dimensions, specifications and quantities before placing an order.

2.5 If materials are required for a specific application or purpose, this must be confirmed in writing prior to supply. Unless expressly agreed, Roofers Warehouse does not warrant suitability outside normal intended use.

3. Pricing & Payment

3.1 The price payable is:

• The amount set out in an accepted written quotation; or
• If no quotation exists, the price applicable at the time the order is accepted.

3.2 GST is payable in addition to the quoted price where required by law.

3.3 Unless otherwise agreed in writing, payment must be made prior to delivery or collection.

3.4 Roofers Warehouse may apply a reasonable surcharge for credit card payments.

3.5 Roofers Warehouse reserves the right to adjust pricing prior to delivery where:

• Supplier or raw material costs increase;
• Delivery schedules are changed at the customer’s request;
• Orders are delayed beyond agreed timeframes;
  • Legislative or regulatory changes affect supply costs.

4. Delivery & Collection

4.1 Delivery dates are estimates only and are not guaranteed.

4.2 The customer must ensure delivery sites are safe, accessible and suitable for unloading.

4.3 Unless otherwise agreed in writing, unloading is the responsibility of the customer.

4.4 If safe access is not available at the nominated site, goods may be unloaded at kerbside or the nearest safe location.

4.5 Additional charges may apply where:

• Delivery vehicles are required to wait on site;
• Redelivery is necessary;
• Storage is required due to delayed collection.

4.6 Risk in the goods passes to the customer upon delivery or collection.

4.7 Customers must have paid their invoice prior to 11am for next day collection

5. Inspection & Claims

5.1 Customers must inspect goods immediately upon delivery or collection.

5.2 Any claim for short supply, damage or incorrect goods must be made in writing within:

• 24 hours for construction site deliveries; or
• 48 hours for other deliveries.

5.3 Goods must not be installed, cut or altered prior to inspection where a claim is intended.

5.4 If goods are confirmed to be faulty or incorrectly supplied, Roofers Warehouse may, at its discretion:

• Replace the goods;
• Repair the goods; or
• Refund the purchase price.

5.5 Installed goods cannot be returned unless defective in accordance with Australian Consumer Law.

6. Returns & Cancellations

6.1 Orders cannot be cancelled once accepted unless agreed in writing.

6.2 Where cancellation is approved, Roofers Warehouse may recover reasonable costs including:

• Restocking fees
• Freight and handling
• Custom cutting or fabrication costs
• Administrative expenses

6.3 Goods cut to length, specially ordered, or made specifically for a customer — including made-to-measure COLORBOND® steel — cannot be returned unless required by law.

7. Installation Services

7.1 Where Roofers Warehouse provides installation services, the customer must ensure the site is properly prepared and compliant with all relevant building requirements.

7.2 Roofers Warehouse is not responsible for delays caused by weather, site access issues, third parties or unforeseen structural conditions.

7.3 Engineering certification, council approvals and compliance obligations remain the responsibility of the customer unless otherwise agreed in writing.

8. Retention of Title

8.1 Ownership of goods remains with Sell Selling Sold Pty Ltd until payment has been received in full.

8.2 Until ownership transfers, the customer must:

• Store goods separately and clearly identifiable;
• Maintain goods in good condition;
• Not encumber or dispose of goods outside ordinary business dealings.

8.3 Where payment remains outstanding, Roofers Warehouse may take lawful steps to recover unpaid goods.

9. Product Information & Suitability

9.1 Roofers Warehouse supplies roofing and building materials including premium COLORBOND® steel and associated products.

9.2 COLORBOND® is a registered trade mark of BlueScope Steel Limited. Manufacturer warranties apply subject to compliance with published installation requirements.

9.3 Customers are responsible for ensuring products are suitable for their intended application.

9.4 While our team provides experienced guidance, customers should seek independent professional advice where engineering or structural certification is required.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, Roofers Warehouse’s liability for any claim relating to supplied goods is limited to:

• Replacement of the goods; or
• Refund of the purchase price.

10.2 Roofers Warehouse is not liable for indirect or consequential loss including loss of profits, project delays, business interruption or loss of opportunity.

10.3 Nothing in these Terms excludes rights available under the Australian Consumer Law.

11. Force Majeure

Roofers Warehouse is not liable for failure or delay in supply caused by circumstances beyond reasonable control, including supplier shortages, transport disruption, extreme weather, government restrictions or industrial action.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the jurisdiction of the courts of Queensland.
